This is a petition under Section 482 Cr.P.C for issuance of directions to respondents No.1 to 4 to reinstate the security provided earlier or new security to the petitioner and his family.
Reply on behalf of respondent No.2 has already been filed. In para 5 of the reply, it is submitted as under :-
“5. It is relevant to mention here that earlier when the petitioner was provided the gunmen, he misused the same. This stand substantiated from the factum of registration of case/FIR No.58 dated 12.05.1998 under Sections 307/452/506/148/149 IPC with Police Station Phillaur against the petitioner and his gunmen. The inquiry officer has found that the petitioner does not have any threat from anybody and

wants to take security on account of disputes pending with the private respondents, to show off and further to gain false publicity so that he could misguide the general public as well as the administration. The example of the same is clear from the recent case registered against him i.e case/FIR No.137 dated 28.07.2010 under Sections 380/406/420 IPC with Police Station Phillaur in which Gurinder Singh alias Rana on the pretext of pursuing the case and further by stating him to be highly connected has cheated a sum of Rs.1.50 lacs and also took away the generator set.”
In view of the detailed reply and the fact that the petitioner is stated to have misused the security provided to him and is involved in number of FIRs, the present petition is disposed of with a direction to Senior Superintendent of Police, Jalandhar to re-assess the threat perception to the petitioner, if any, and pass appropriate orders accordingly.
Disposed of accordingly.
