Petitioner seeks concession of regular bail in a case registered at the instance of Deen Mohd. alleging that his daughter has been allured and kidnapped by the petitioner with a promise of marriage. The daughter of the complainant is present in the Court and has stated that she had voluntarily married with the petitioner and at present is staying with the family of the petitioner.
In view of the said circumstances, the story of the prosecution that petitioner along with others had kidnapped the daughter of the complainant or raped her would be debatable.
Without expression of any opinion on the merits of the case, the petition is allowed. Petitioner is ordered to be released on bail on his furnishing bail bonds/surety bonds to the satisfaction of CJM/Duty Magistrate, Mewat.
