Petitioner along with his co-accused is alleged to have fired at police party. In the return fire, the co-accused of the petitioner Jasmer was allegedly injured.
Counsel for the petitioner submits that the petitioner has been in custody w.e.f., 01.08.2010 and that it is a case of no injury. Chances of tampering with the evidence are remote as all the prosecution witnesses are official witnesses.
Taking into consideration the period of detention suffered by the petitioner and the nature of the allegations, the petitioner can be granted the concession of bail.
The petition is allowed. It is ordered that the petitioner will be released on bail on his furnishing bail bonds/surety bonds to the satisfaction of the trial Court.
