This order will dispose of two petitions. One petition is

filed by Parminder Kaur i.e. Criminal Misc. No. M-23559 of 2011 and the another one is filed by Lakhbir Singh i.e. Criminal Misc. No. M-

24600 of 2011, in a case registered at the instance of Sandeep Kaur

wife of Satnam Singh, alleging that on 29.07.2010 she was called by the petitioner Lakhbir Singh on the pretext that her husband Satnam Singh was not well. She along with her mother Devinder Kaur and brother Hardip Singh reached at village Magror at 9:30 PM, where four sisters of Satnam Singh with their husbands were present. One Tantrik Baba along with another boy had been called on 31.07.2010 in the morning. The above said tantrik baba along with his chela had started hitting the husband of the complainant with belts – tong(chimta) in a room and asked everyone to go out of the room. When the door was opened by the complainant, her husband Satnam Singh was found dead, allegation was levelled against all the sisters of the deceased for having committed the murder of husband of the complainant in connivance of tantrik baba.

So far as, Lakhbir Singh is concerned, who is the husband of Paramjit kaur, was granted the concession of regular bail by this Court. It will be debatable during the trial that the family members of Satnam Singh had any motive to get him killed through the tantrik baba as alleged by the complainant.

Without expression of any opinion on merits of the case, it is sufficient to observe that similarly circumstanced co-accused have been granted the concession of bail by this Court. The petitioners have been in custody w.e.f. 21.02.2011(Parminder Kaur) and 11.04.2011 (Lakhbir singh). In view of the nature of the allegations levelled against the petitioners, they can be granted the concession of regular bail.

Petitions are allowed. The petitioners are ordered to be released on their furnishing bail bonds/surety bonds to the satisfaction
