Prayer in the present petition is for grant of bail pending trial to the petitioner in FIR No. 70 dated 29.7.2010, under Section 15 of the NPDS Act, 1985, where the alleged recovery from the petitioner is 55 kilograms of poppyhusk.
Learned counsel for the petitioner submitted that the petitioner had met with an accident resulting into head injury. He is to be operated upon. On account of certain administrative problems, the petitioner is not being regularly taken to the hospital.
Learned counsel for the State has filed an affidavit of Ravinder Loomba, Superintendent of Police (Prison), Central Jail, Ludhiana dated 18.10.2010 in court, which is taken on record. Along with the affidavit, a communication dated 7.9.2011 from Professor & Head, Department of Plastic Surgery, PGI, Chandigarh has been produced. It is mentioned therein that surgery of the petitioner will serve only to improve the aesthetic appearance of the petitioner. It is unlikely to improve any functional benefit. He further submitted that there are six other cases against the petitioner.
