Buta Singh Vs State of Punjab

Learned counsel for the petitioner submitted that it is a case of blind murder. The author of theFIR is Sukhbir Singh, father of the deceased. The petitioner is not named in the FIR got registered by him on 17.7.2010. He was named in the supplementary statement of the complainant recorded eight days after the registration of the FIR on 25.7.2010. Now the statement of the complainant has been recorded in court, where he denied having given any supplementary statement on 25.7.2010. Besides that, there is no other material with the prosecution to have linked the petitioner with the crime. The petitioner is in custody since 29.7.2010.

Learned counsel for the State did not dispute the fact that eyewitnesses to the crime, who have appeared in the court, have turned hostile. Besides that, there is only recovery of knife, handkerchief and letter from the petitioner.

After hearing learned counsel for the parties and considering the submissions made above, in my opinion, the petitioner deserves concession of bail pending trial. He is directed to be released on furnishing of bail bonds to the satisfaction of Chief Judicial Magistrate/Duty Magistrate, Ludhiana.
