The present petition has been filed under Section 482 Cr.P.C. directing respondents No.2 and 3 to submit status report of case FIR No. 83 of 2000, registered at Police Station “B” Division, Amritsar, under Sections 411 & 414 IPC, 18, 21 & 22 of the Narcotic Drugs and Psychotropic Substances Act, 1985, Section 25 of the Arms Act, 1959 and Section 3 of the Official Secrets Act, 1923. It is stated that FIR, in the present case, was registered in the year 2000. The petitioner is not being granted passport due to pendency of the above said FIR.

Mr. B.S. Sra, Additional Advocate General, Punjab, on instructions from Balwant Singh, Assistant Sub Inspector, Police Station “B” Division, Amritsar, has submitted that the Investigating Agency has

decided to submit an untrace report. Learned counsel for the respondents has further submitted that the untrace report shall be submitted within a period of one month in the Court of the concerned Area Judicial Magistrate.

Learned counsel for the petitioner has submitted that even if the untrace report is submitted within a period of one month, the Court will take a long time to give its final decision thereupon.

After hearing learned counsel for the parties, the present petition is disposed of with a direction that as stated, the Investigating Agency shall submit its final report along with the opinion of the Investigating Officer in the Court of the concerned Area Judicial Magistrate within a period of one month from today and thereafter, the concerned Judicial Magistrate shall take a final decision thereupon within a period of two months.
