It will be debatable during trial whether the injuries attributed to the petitioner were as a result of a defensive measure, as the petitioner has also received grievous injuries. The petitioner has already joined the investigation.
The interim order dated 06.05.2011 is made absolute. It is ordered that in case of arrest of the petitioner, he shall be released on bail to the satisfaction of the Investigating Officer subject to the condition that he will join the investigation as and when required by the police and will not tamper with evidence or hamper the investigation in any manner.
