This is a petition for anticipatory bail filed in case bearing FIR No.4 dated 4.2.2010 under Sections 307/324/323/34 registered at Police Station Ballianwali, Distt. Bathinda.
On 26.04.2011 the following contention was noticed:-
“Learned counsel has argued that the petition was originally arrested but on an inquiry made on the demand of the public and the Panchayat, was found innocent and was thereafter released on bail. However, now he has been summoned under Section319 Cr.P.C.”
Learned DAG, on instructions from ASI Jagdish Singh, has accepted these factual assertions.
It is not disputed that investigation is complete. In the circumstances I deem it appropriate to grant the concession of anticipatory bail to the petitioner. Of course, if he is convicted, he will have to undergo whatever punishment is awarded to him.
This petition is allowed. Petitioner will appear before the learned trial Court and submit the bail bonds and the trial Court will accept the same to its satisfaction.
