The petitioner seeks grant of anticipatory bail in case FIR No.188, dated 8.4.2011, registered under Sections 420, 506, 34 of the IPC, at Police Station Jagadhri City, District Yamunanagar.
The broad-brush case- allegation is that the petitioner is interfering in the property of the complainant and has sold the same fraudulently.
It is also not disputed that civil suits are pending between the parties. Counsel for the complainant has argued that apart from these civil suits which have been forced by the petitioner, the fact is that the complainant even got interim orders from the Civil Court but whenever the complainant wants to raise any construction, the petitioner disrupts the same with the help of gunda elements.
Counsel for the petitioner has countered this by saying that the matter regarding title would obviously be decided by the Civil Court and that the petitioner has no intention of stopping the complainant from raising any construction except in due course of law.
In this view of the matter, I deem it appropriate to grant the concession of anticipatory bail to the petitioner. Consequently, the

petitioner is directed to appear before the Investigating Officer on 25.5.2011 between 10 am to 4 pm and on any other day which the Investigating Officer may require him to so appear and in the event of his arrest, the petitioner shall be released on anticipatory bail by the Investigating Officer to his satisfaction subject to the conditions laid down in Section 438(2) of
the Cr.P.C.
