This petition has been filed under Section 438 Cr.P.C. for grant of anticipatory bail to the petitioner in case F.I.R. No.37 dated 15.02.2011 registered under Sections 363-A IPC at Police Station Cheeka, District Kaithal, Haryana.
The broad brush allegations are that the petitioner was instrumental in snatching away the child of the complainants and handing over to one Surinder Kaur. There are documents on record which indicate that at one stage the complainants may have themselves handed over the child to the aforesaid Surinder Kaur. Of course this would be a matter of proof. It is however not denied that even as per the FIR the child was 'snatched' on 10.04.2010 but the complaint was made only in November, 2010.
It is also not disputed that the petitioner has repeatedly joined the investigation.
On instructions from ASI Udaybir Singh learned Deputy Advocate General has accepted that the petitioner has joined the investigation.

In the circumstances, in view of the statement made by learned Deputy Advocate General, the interim order dated 04.05.2011 is confirmed subject to the conditions envisaged under Section 438(2) Cr.P.C.
Accordingly, the petition stands disposed of.
