Rahul & Ors. Vs State of Punjab & Anr.

The present petition is filed under Section 482 Cr.P.C. for quashing of FIR No.28 dated 21.2.2011 registered under Sections 326/324/148/149 IPC, at Police Station Gurdaspur, on the basis of compromise.

The parties were directed to remain present and indeed are present before the Court today. On 17.8.2011, this Court had directed the State to submit the investigation report of the case, which was likely to be completed shortly. The final report was also called for.

State counsel today points out that the Police has prepared the cancellation report, which is yet to be approved by the competent authority.

The investigating agency may take further action in accordance with law and submit the cancellation report after it is finally approved by the competent authority. In the meantime, the petitioners as well as the complainant would be at liberty to move an appropriate application before the trial Court on the basis of compromise, which shall be considered by the trial Court to pass an appropriate order in accordance with law.

The petition is, accordingly, disposed of.
