“Learned counsel for the petitioner contends that the tenant sought no leave to defend and the Rent Controller, Amritsar, vide his order dated 13.9.2010 (Annexure P4), has committed a grave error to proceed with the petition, filed under Section 13-B of the East Punjab Urban Rent Restriction Act, 1949 as an eviction petition, in the ordinary course, bypassing the special procedure specified in the Act. Issue notice of motion for 3.12.2010.”

Thereafter, nobody caused appearance on behalf of the respondent and this Court had called for the record from the trial Court. The record has not been received.

At this stage, counsel for the petitioner states that calling of the record will unnecessarily delay culmination of the eviction proceedings, therefore, he will confine his prayer that the application

(Annexure P-3), wherein a prayer was made to the Rent Controller that the ejectment proceedings be dealt with and decided under Section 18 of the East Punjab Urban Rent Restriction Act, 1949, be decided.

I find merit in the alternative prayer made by counsel for the petitioner. Accordingly, present revision petition is hereby disposed of by directing the Rent Controller, Amritsar to decide the application (Annexure P-3) within one month from the date of receipt of a certified copy of this order.
