Plaintiff/petitioner has filed the present revision petition under Article 227 of the Constitution directed against the order dated 8.10.2011 (P2) whereby the learned District Judge, Ambala has declined his prayer for transferring the appeal listed before one court to the other on the mere averment that the petitioner apprehends that the appeal filed by him against the dismissal of his suit pending before the appellate court concerned would not be fairly decided in view of the observation of the court that “if Lehna Ram would not have bequeathed property in favour of his daughters then for whom else he would have left the property for”.
After arguing for sometime, learned counsel seeks permission to withdraw the petition.
Ordered accordingly.
