Plaintiff/petitioner has filed the instant revision petition under Article 227 of the Constitution for issuance of directions to the trial court to decide his suit for mandatory injunction in a time bound manner.
It was alleged that despite 3 years having elapsed, no written statement has still been filed by the respondents/defendants.
Vide order dated 5.10.2011 Registry was directed to seek a status report from the Court concerned in this regard.
In compliance thereof, learned Chief Judicial Magistrate, Faridabad, vide letter dated 15.11.2011 has intimated that the suit was filed on 27.10.2008 in which defendant no.2 appeared on the very next date and filed counterclaim. Reply to the counterclaim was not filed by the petitioner/plaintiff despite seven adjournments.
At the time of hearing, learned counsel for the petitioner prays for permission to withdraw the revision petition.
Ordered accordingly.
