Petitioner was appointed as daily wager on 6.2.1988 as Water Pump Operator Grade-II. In the year 1993 the daily wagers were regularized and the petitioner was also regularized on 31.3.1993. It is stated that the post on which the petitioner was engaged initially is a Group-C post and thus the petitioner was required to be regularized against Group-C post. It is also stated that the case of the petitioner was recommended for regularization against Group-C post. The petitioner claims to have served a legal notice dated 19.10.2009. This petition has been filed seeking a direction to regularize the petitioner against Group-C post.
It is admitted position that the petitioner was regularized in the year 1993 w.e.f. 31.3.1993. He accepted the post and is working there for the last almost 17 years. At this stage the petitioner claims regularization on a higher post. A large number of employees must have been employed during this period on the higher posts by adopting the appropriate procedure. If, the claim of the petitioner is allowed at this belated stage, it is likely to affect the claim of a large number of persons. Otherwise also, petitioner having been appointed on compassionate basis has no right to claim a particular post.
No merit, petition dismissed.
