Counsel for the University is justified in saying that the relief claimed in the writ petition is infructuous. The prayer was for permitting the petitioner to give special chance to appear in the examination, which was to commence on 31.07.2010. Since the date has already gone, no effective order now can be passed.
The writ petition is dismissed as having become infructuous. If the petitioner has deposited fee the same shall be refunded on the application made in this regard.
