This is a petition under Section 438 Cr.P.C. seeking pre-arrest bail in a case registered against the petitioners under Sections 323, 324, 326 IPC at Police Station Ding, District Sirsa, vide FIR No.105 dated 7th June, 2010.
Learned counsel for the petitioners submits that he may be allowed to withdraw the present petition in respect of petitioner No.3, namely Ved Parkash with liberty to surrender before the trial court and seek regular bail.
In view of the statement made by learned counsel for the petitioners, this petition is dismissed as withdrawn qua petitioner No.3 with the liberty as aforesaid.
In respect of petitioners No.1 & 2, learned State counsel submits that pursuant to order dated November 10, 2010, petitioners

No.1 & 2 have joined the investigation and are no longer required for custodial interrogation.
In view of the statement made by learned State counsel, the interim order dated November 10, 2010 qua petitioners No.1 & 2 is hereby made absolute subject to the conditions envisaged by Section 438(2) Cr.P.C.
The petition stands allowed in aforesaid terms.
