Pargat Singh & Others Vs State of Punjab & Others

The present petition has been filed under Section 482 of the Code of Criminal Procedure for quashing of the FIR No. 515, dated 27.10.2008 registered under Sections 363, 366 & 120-B IPC at Police Station Sadar Patiala and all subsequent proceedings.

Learned State counsel has filed an affidavit of Ranbir Singh Khatra, Senior Superintendent of Police, Patiala in court today. The same is taken on record. He submits that in light of the changed circumstances and certain facts which have come to light during the course of investigation, submission of challan would be a futile exercise. He submits that investigating agency has decided to file an untraced report before the competent court of jurisdiction shortly.

Learned counsel for the petitioner submits that in view of above, he may be allowed to withdraw the present petition with liberty to the petitioner to file afresh in case any cause of action survives.

Dismissed as withdrawn with liberty as aforesaid.
