This is a petition under Section 439 Cr.P.C. seeking regular bail in a case registered against the petitioner vide FIR No. 453 dated 19.11.2009 under Sections 148, 149, 323, 302, 325, 506, 452 IPC at Police Station Sadar Palwal, District Palwal.

Learned counsel for the petitioner has argued that no injury on person of the deceased is attributed to the petitioner. According to learned counsel, only lathi blow to the complainant is attributed to the petitioner. He submits that investigation of the case has been completed and trial has commenced, thus, no useful purpose would be served by detaining the petitioner in custody during the pendency of the trial.

Prayer for bail has been opposed by learned State counsel on the ground that allegations against the petitioner are serious in nature. However, it is not disputed that trial of the case is still at its initial stage.

I have heard learned counsel for the parties.

It appears that in the FIR there is no allegation that petitioner inflicted any injury on the body of the deceased. The petitioner has been in custody since 31.12.2010 and the trial is still at its initial stage. Under the circumstances, I am of the considered view that no useful purpose would be served by detaining the petitioner in custody during the pendency of the trial. Without expressing any opinion on the merits of the case, I deem it appropriate to grant regular bail to the petitioner. Accordingly, the petition is allowed and petitioner is ordered to be enlarged on bail to the satisfaction of Chief Judicial Magistrate/Duty Magistrate, Palwal. July 07, 2010 (RAJAN GUPTA) Ajay JUDGE
