This is a petition filed under Section 438 of the Code of Criminal Procedure seeking anticipatory bail in a case registered against the petitioner vide FIR No. 137 dated 16.04.2010 under Sections 447, 448, 454, 380, 506, 120-B IPC at Police Station Sector 5, Panchkula.
Mr. Bedi contends that pursuant to order dated 26.04.2010, the petitioner has joined the investigation and is cooperating with the investigating agency. He also submits that after the petitioner was granted permission to go abroad vide order dated 21.05.2010, the petitioner returned and again joined the investigation.
This factual contention is not disputed by learned State counsel who has made this statement on instructions from Sub-Inspector Balwan Singh (present in court)
In view of above, the instant petition is allowed. The petitioner is granted the concession of anticipatory bail subject to the conditions as envisaged under Section 438(2) Cr.P.C.
