With the consent of learned counsel for the parties, following order is being passed:-
(i) Cost ought not to have been imposed on the petitioner, hence impugned order dated 18.2.2010 be set aside.
(ii) Amendment application moved by the plaintiff correcting the name of the defendant in the plaint shall be decided by the trial Court in accordance with law.
(iii) Trial Court shall proceed with the case without granting any undue adjournment to either of the party.
The petition is disposed of with the consent of learned
counsel for the parties in the aforesaid terms.
