This is an application for bringing on record the legal representatives of Jitta Singh (since deceased) – appellant.

It is stated that Jitta Singh died on 29.10.2006 and there is no other Legal representative of Jitta Singh except Legal representatives mentioned in para 2 of the application. An affidavit in support of the same has also been placed on record.

In view of the same, application for bringing on record Legal Representatives of Jitta Singh as mentioned in para 2 are ordered to be impleaded as such.

C.M. is allowed with all just exceptions.

Learned counsel for the appellants states that the matter is being covered by judgment of this Court rendered in R.F.A. No. 3008 of 2008 titled as Poonam vs. State of Haryana etc. decided on 25.2.2009. Copy of the said R.F.A. has also been placed on record.

Mr. Deepak Balyan, Advocate accepts notice on behalf of respondent No. 2.

Learned counsel for the respondents, after examining the said judgment has very fairly stated that the said R.F.A. is covered by the judgment referred above. .

In view of the submissions made by learned counsel for the parties, the present RFA is disposed of in the same terms as R.F.A. No. 3008 of 2008 titled as Poonam vs. State of Haryana etc. decided on 25.2.2008.

The parties through their counsels are directed to appear before the District Judge, Panchkula on 5.10.2009 for further proceedings.
