The petitioner has filed the instant petition under Articles 226/227 of the Constitution of India challenging order dated 12.5.2008 (Annexure P-10) passed by Managing Director, Jind Cooperative Sugar Mills Ltd., whereby his claim of the seniority over and above respondent Nos.2 to 4, has been rejected.
It is conceded position that against the said order, the petitioner has an alternative remedy of appeal before the Board of Directors of the Jind Co-operative Sugar Mills Ltd.
Learned counsel for the respondents have no objection, if the petitioner avails the said remedy.

In view of the above, counsel for the petitioner states that the petitioner may be permitted to withdraw this petition with liberty to file an appeal before the Board of Directors of the respondent-Mill Dismissed as withdrawn with the aforesaid liberty.
However, if any such appeal is filed by the petitioner within a period of one month before the Board of Directors of respondent- Mill, they are directed to consider and decide the same after providing opportunity of hearing to the petitioner by passing a speaking order preferably within a period of three months.
