The petitioner(plaintiff) has filed this petition against order dated 9.12.2002 passed by the Additional District Judge, Ludhiana, whereby the appeal filed by the defendant (respondent No.1) was accepted and order dated 17.8.2001 passed by the Civil Judge, Junior Division, Ludhiana, on the application under Order 39 Rules 1 & 2 read with Section 151 C.P.C. was set aside.
During the course of arguments, learned counsel for respondent No.1 has submitted that during the pendency of this revision petition, the parties have entered into compromise and the suit filed by the plaintiff has already been disposed of by the Trial Court. In view of this, this revision petition has become infructuous.
Dismissed as infructuous.
