The petitioner, who is working as Senior Assistant Branch Manager, Branch Office Pirthala, has filed this petition challenging his transfer from Branch Office Pirthala to Branch Office Samain in District Fatehabad.
While issuing notice of motion, the impugned transfer order (Annexure P-3) was stayed. Concededly, the petitioner is now working at Branch Office Pirthala and he is going to retire on August 31, 2009. Counsel for respondent No.2 states that though the petitioner has no legal

right to remain on a particular post and a prima facie case to challenge his transfer, but on instructions from respondent No.2 and keeping in view the fact that the petitioner is going to retire on August 31, 2009, he states that the petitioner will not be transferred from the aforesaid office till his retirement. In view of this, counsel for the petitioner states that he does not want to press this petition.
Dismissed as not pressed.
