The impugned award passed by the Assistant Registrar, Cooperative Societies (Annexure P-5) dated 3.6.2009 is an appealable award. In this view of the matter, learned counsel for the petitioner seeks to withdraw this petition with liberty to file an appeal before the competent Appellate Authority. It is also prayed that the limitation for filing the appeal be condoned.
It is open to the petitioner to make appropriate application before the Appellate Authority for condonation of delay, in view of the pendency of the writ petition before this Court. The Appellate Authority will consider the application and pass an appropriate order in accordance with law.
