Bimla Devi Vs State of Haryana & Ors.

The petitioner, who was working as S.S. Mistress in R.D. Arya Girls High School, Karnal, and has retired on 31.12.2007 on attaining the age of superannuation, has filed the instant petition for issuing direction to the respondent school to release her salary with effect from August, 2006 to 31.12.2007 as well as the retiral benefits, which the petitioner is entitled under the provisions of Haryana Aided School (Special Pension and Contributory Provident Fund) Rules, 2001. It is the case of the petitioner that in spite of the fact that the Government has granted the aid and sanctioned the amount, the respondent school is not releasing the same by putting an unreasonable condition that the petitioner has to forego 25% share of the management.

In view of the above, after hearing counsel for the petitioner, without issuing notice of motion as it will un-necessary delay the matter, this petition is disposed of with liberty to the petitioner to make a representation to the Director, School Education, Haryana, within a period of two weeks from today, with regard to payment of salary and her retiral benefits. If any such representation is made, the same shall be considered and decided by the Director, School Education, Haryana, in accordance with law by passing a speaking order, expeditiously, preferably within three months.
