Mahesh Chand Vs Dhbvn

The petitioner, who was working as Assistant Foreman with Dakshin Haryana Bijli Vitran Nigam and has retired on 31.1.2009 on attaining the age of superannuation, has filed the instant petition for issuing direction to the respondents to count the work charge service, rendered by him prior to his regularisation, towards the qualifying service for the purpose of pension. It is the case of the petitioner that in this regard, he has served a legal notice dated 29.4.2009 upon the respondents, copy of which has been annexed as Annexure P-6, but till date, the respondents have not decided the said legal notice. Counsel for the petitioner states that at this stage, the petitioner will be satisfied if a direction is issued to respondent No.2 to consider and decide the aforesaid legal notice expeditiously.
