Sham Lal Vs State of Punjab and Ors.

The petitioner, who was working as Sewadar, a Class IV post, in Municipal Council, Ferozepur and retired on 30.12.2008 on attaining the age of superannuation, has filed the instant petition for issuing direction to the respondents to release his retiral benefits, which according to him have not been released so far. It is the case of the petitioner that in this regard, he served a legal notice dated 1.6.2009, copy of which has been annexed as Annexure P-1, but till date, no action has been taken on the same. Counsel for the petitioner states that at this stage, the petitioner will be satisfied if a direction is issued to respondents No.2 and 3, who are the competent authority, to consider and decide the aforesaid legal notice served by the petitioner.

In view of the aforesaid facts, without issuing notice of motion as it will un-necessary delay the matter, this petition is disposed of with a direction to respondents No.2 and 3 to consider and decide the legal notice dated 1.6.2009 (Annexure P-1) in accordance with law, expeditiously and preferably within a period of three months. In case, the petitioner is found entitled to the retiral benefits, the same shall be released to him forthwith.
