The petitioner, who was working as Picker with Food Corporation of India, Food Storage Depot, Dhuri, District Sangrur, has filed the instant petition for issuing direction to respondent No.3 to send pension papers of the petitioner to the Regional Provident Fund Commissioner, which have not been sent so far, without any justification or reason.

It is the case of the petitioner that on attaining the age of 58 years, which he attained on 25.6.2006, the petitioner became eligible for grant of pension under Employees Pension Scheme, 1995. It is further the case of the petitioner that even after passing of three years period and in spite of petitioner having approached respondent No.3 many times, his documents pertaining to pension papers have not been forwarded to respondent No.1. In this regard, the petitioner served a legal notice dated 10.2.2009 (Annexure P3), but till date no decision has been taken on the same and respondent No.3 is sleeping over the matter.

In view of these facts, without issuing notice to the other side as it will unnecessary delay the matter, this petition is disposed of with a direction to respondent No.3 to consider and decide the said legal notice and to forward the documents pertaining to pension papers of the petitioner to respondent No.1 within a period of two months. In case the pension papers are sent by respondent No.3 to respondent No.1, respondent No.1 is further directed to release the rightful dues of the petitioner, in accordance with law, expeditiously.
