The petitioner apprehends arrest in a case registered at the instance of Jang Singh alleging that Balkar Singh main accused accompanied by others had fired a shot at Hamir Singh. So far as the petitioner is concerned, he, though named in the FIR , was found innocent during investigation by the police. After having been summoned u/s 319 Cr.P.C. he apprehends arrest. The petitioner has not been attributed any injury on the person of the deceased or any witness.
Pursuant to the interim order passed by this court, he has already put in appearance before the trial court. In view of the fact that the petitioner has not been attributed any injury and he was allegedly present on the spot armed with a balam, he can be granted the concession of prearrest bail.
This petition is allowed and interim order dated 12.2.2009 is hereby confirmed subject to the condition that he will furnish bail bonds in the sum of Rs.40,000/- with one surety of the like amount to the satisfaction of the court concerned. The petitioner will continue to appear before the trial Court and will not absent himself without any sufficient cause.
