Learned counsel for the State on instruction from Head Constable Sushil Kumar, who is present in Court, submits that pursuant to order dated 02.04.2009 petitioner has joined the investigation and is no longer required for custodial interrogation.
In the facts and circumstances of the case, the order dated 31.10.2008, passed by this Court granting ad-interim anticipatory bail to the petitioner is hereby, made absolute, subject to the conditions as envisaged under Section 438(2) Cr.P.C.
