Learned counsel for the petitioner submits that there was a sudden altercation in Ahata of English Wine shop in the Motor Market, Mani Majra. In the said altercation, the petitioner is alleged to have inflicted an injury in the stomach of one boy namely Tarsem with a broken liquor bottle. According to the counsel, the petitioner is in custody since 27.10.2008 and no useful purpose would be served by keeping him in custody during pendency of the trial.
Learned counsel for the State has submitted that challan in this case has been submitted on 20th January, 2009 and the trial has commenced.
In the facts and circumstances of the case, I am of the view that no useful purpose would be served by keeping the petitioner in custody during pendency of the trial. Therefore, without expressing any opinion on the merits of the case, the petitioner is directed to be released
