Learned counsel for the petitioner submits that son of the petitioner namely Raj Brinder Singh and his wife Sweety (complainant) have compromised the matrimonial dispute and they are living together at the moment.
Learned counsel for the State (on the instructions from Head Constable Surenderpal Singh, who is present in Court) affirms this fact.
Keeping in view the totality of facts and circumstances of the case, I am of the view that the petitioner deserves the concession of anticipatory bail. Consequently, the present petition is allowed and the interim order dated October 01, 2008 is hereby made absolute subject to conditions envisaged by Section 438 (2) Cr.P.C.
