Counsel for the petitioner submits that in terms of the order passed by this Court, the petitioner has joined the investigation. Even according to the FIR, the petitioner, who is handicapped, had only caused simple injury. The grievous injury is attributed to Manphul, who is in custody. This fact is admitted by the counsel for the State, on instructions received from ASI Harbans Lal.
In view of the above, order dated 9.9.2009 is hereby made absolute. The petitioner shall keep on joining the investigation as and when called for. He shall also abide by the provisions of Section 438(2) Cr.P.C.
The petition is disposed of.
