Learned Counsel for the petitioner submit that pursuant to the order dated 09.09.2009, petitioner has joined the investigation.
Learned counsel for the state, on instructions received from ASI Bawa Singh, admits that the petitioner has joined the investigation. He further submits that the petitioner is no more required for further custodial interrogation as un-traced report has also been prepared.
In view of the above, order dated 09.09.2009 is hereby made
absolute.
It is directed that the petitioner shall abide by the conditions as envisaged by section 438(2) Cr.P.C.
