Learned counsel for the petitioner states that the present petition may be dismissed as withdrawn, with liberty to the petitioner to get back to this Court afresh after the statements of Jaswinder Singh and Darshan Singh (the two witnesses who had allegedly attested the disclosure statement made by the petitioner) are recorded.
The State is directed to ensure that the statements of both the witnesses aforementioned are recorded on 27.10.2009 for which date the matter is already fixed before the learned Trial Court for recording of prosecution evidence.
Dismissed as withdrawn, with liberty aforementioned.
