The petitioner in the present case though was named in the FIR, but was found to be innocent during investigation. After some prosecution evidence was led he has been summoned to face trial on an application filed by the prosecution, under Section 319 Cr.P.C.
In terms of the order passed by this Court on 11.8.2009, he has already put in appearance before Court below and has furnished his bail bonds.
As the petitioner is facing trial and no recovery or investigation is to be made from him, the interim bail granted to the petitioner on 11.8.2009 is made absolute.
The petition stands disposed of.
