The petitioners in the present case though were named in the FIR, but were found to be innocent during investigation. After some prosecution evidence was led they have been summoned to face trial on an application filed by the prosecution under Section 319 Cr.P.C.
In terms of the order passed by this Court on May 1, 2009, they have already put in appearance before Court below and have furnished their bail bonds.
As the petitioners are facing trial and no recovery or investigation is to be made from them, the interim bail granted to the petitioners on May 1, 2009 is made absolute.
The petition stands disposed of.
