The petitioner in the present case is an accused in FIR No. 985 dated 28.12.2008 registered under Sections 498-A, 406, 506, 376(G), 34 IPC which was recorded on the complaint of his wife. Now in her statement recorded before the Court she has categorically stated that the petitioner was not involved in the crime. He has never demanded any money or dowry after his marriage with the complainant and she never stated the facts as have been mentioned in the FIR regarding the petitioner. It is further stated by her that even after the incident she has been residing with her in-laws.
Be that as it may without opining on the merits of the controversy, the petitioner is directed to be released on bail, pending trial, on furnishing of bail bonds to the satisfaction of Chief Judicial Magistrate/Duty Magistrate, Rohtak.
The petition is disposed of.
