In earlier case registered against the petitioner, though he was convicted by the trial court, but subsequently was acquitted by this Court vide judgment dated 7.3.1996 in Criminal Appeal No. 175-SB of 1995. In the present case, it is alleged that 11 kilograms of Poppy Straw was recovered from the petitioner, which is a non-commercial quantity. The petitioner is in custody since 27.12.2008. The trial is likely to take some time.
Accordingly, it is directed that the petitioner be released on bail on furnishing bail bond to the satisfaction of Chief Judicial Magistrate/ Duty Magistrate, Jhajjar.
The petition stands disposed of.
