Petitioner has brought this petition under section 439 of Code of Criminal Procedure for seeking regular bail in case FIR No. 186 dated 31.8.2006 under sections 194, 211, 120-B IPC and 25 of the Arms Act registered at Police Station Sadar, Panipat.
Learned counsel for the petitioner contends that the petitioner in this case could not appear on one date before the trial court i.e. on 30.10.2008 on account of noting down the wrong date. The co-accused of this case also could not appear on the aforesaid date as they had also noted down the wrong date. In such circumstances, this Court had already granted bail to the co-accused vide order dated 16.4.2009 passed in Criminal Misc.-M No. 5893 of 2009.
