Petitioner has brought this petition under Section 439 of the Code of Criminal Procedure for seeking regular bail in case F.I.R.No.125 dated 14.05.2008 under Sections 452, 323, 324, 427, 353, 148, 149 I.P.C., registered at Police Station Maqsudan, Jalandhar.
Learned counsel for the petitioner submits that the petitioner is in custody in this case since 20.12.2008. She further submits that no injury is attributed to the petitioner. Even otherwise, he was empty handed at the time of alleged occurrence. This assertion purtforth by learned counsel for the petitioner is not rebutted by learned State counsel.
In the given facts and circumstances and without commenting on the merits of this case, the petitioner is ordered to be released on bail on his furnishing bail/surety bonds to the satisfaction of Chief Judicial Magistrate/Duty Magistrate, Jalandhar.
Criminal Misc. is disposed of.
