Learned counsel for the petitioner submits that pursuant to the order dated 06.5.2009, the petitioner has already joined the investigation. This fact is admitted by learned State Counsel on instructions from Baldev Singh, ASI.
In view of the above, the order dated 06.5.2009 is made absolute. The petitioner shall keep on joining the investigation as and when called and shall abide by the provisions of Section 438 (2) Cr.P.C.
The petition is disposed of.
