Learned counsel for the petitioner, inter alia, contends that neither the petitioner has been named in the FIR nor he can be implicated in this case on the disclosure statement suffered by the co-accused. He further submits that pursuant to the order dated 24.04.2009, petitioner has joined the investigation.
Learned counsel for the State/respondent, on instructions received from HC Narinder Kumar, admits that the petitioner has joined the investigation and challan has also been presented.
In view of the above, order dated 24.04.2009 is hereby made absolute.
It is directed that the petitioner shall abide by the conditions as envisaged by Section 438(2) Cr.P.C.
