Learned counsel for the petitioner, inter alia, contends that in the enquiry report conducted by the police, the petitioner is found innocent. He further submits that pursuant to the order dated 21.04.2009, petitioner has joined the investigation.
Learned counsel for the State/respondent, on instructions received from ASI Jaswinder Singh, admits that the petitioner has joined the investigation and is no more required for custodial interrogation.
In view of the above, order dated 21.4.2009 is hereby
made absolute.
It is directed that the petitioner shall abide by the conditions as envisaged by Section 438(2) Cr.P.C.
Petition is disposed of.
