Learned counsel for the petitioner submits that though petitioner has been declared a proclaimed offender, he is ready to surrender before the trial court and face trial. Learned counsel further submits that petitioner was not arrested on the spot and recovery alleged in the case is of 2 kgs of poppy husk which is less than small quantity.
Under the circumstances, petition is disposed of and it is directed that in case petitioner surrenders before the trial court within a week on receipt of certified copy of this order, his bail application shall be decided within a week thereafter. In that event arrest of the petitioner shall remain stayed till the decision of his bail application.
