Balbir Singh Vs Ram Pal and Anr.

Mr. Vikram Singh, Advocate appears for respondents. He very fairly submitted that the appeal against the order passed by learned trial Court dated March 27, 2009 is pending before the learned Court below for 15.5.2009. The interim order granting status-quo regarding construction granted by this Court on April 2, 2009 may continue till the decision of the appeal by the learned lower Appellate Court.

Learned counsel for the petitioner submitted that inspite of statusquo order granted by this Court, the respondents are still raising construction.

Considering the fair stand of the respondents, it is directed that the interim order passed by this Court shall continue till the decision of appeal before the learned Lower Court below. However, it is made clear that the passing of interim order by this Court shall not prejudice the learned Court below in any manner whatsoever which shall consider the appeal pending before it in terms of the material placed on record. As regards the contention of learned counsel for the petitioner in respect of violation of interim stay granted by this Court, he may avail of remedies in accordance with law.

The revision petition is disposed of.
