(O&M)Krishan Kumar Vs Lehari Singh

This Revision Petition is directed against the order dated 21.3.2006 passed by the learned Additional Civil Judge [Senior Division], Pehowa whereby the application for providing police help moved by the respondent – plaintiff has been allowed. The said order was passed in a suit for permanent injunction.

While admitting the revision petition, this Court vide order dated 3.04.2006 stayed operation of the impugned order dated 21.03.2006.

The record reveals that the suit was filed in the year 2004. There is every likelihood that by now the suit might have been decided. In any case, the parties have re-conciled with the interim order passed by this Court more than three years back.

For the reasons afore-stated, I am not inclined to go into

the merits of the rival contentions and dispose of this revision petition with a direction that the impugned order dated 21.03.2006 shall not be given effect during the pendency of the suit.

The observations made in the impugned order as also in

this order shall, however, not be construed as an expression of opinion on the merits of the case.
